Online Payment Terms and Conditions

  1. Introduction
    1. Mr Clutch Autocentres Ltd. recommends that you print out and keep a copy of these terms and conditions for future reference.
    2. These terms and conditions apply to all transactions on this website. Please read them carefully. They do not affect your statutory rights.

    4. These terms and conditions apply to the use of this website and by accessing this website and/or placing an order you agree to be bound by the terms and conditions set out here. If you do not agree to be bound by these terms and conditions you may not use the online ordering offered by this website.
    5. The term ‘service(s)’ covers all services offered by Mr Clutch Autocentres Ltd. including, but not limited to: MOTs, car servicing, air conditioning recharges, etc.
  2. The Contract between Us
    1. Once payment has been received, Mr Clutch Autocentres Ltd. will confirm that your order has been received by sending an email to the email address provided in your order form. Mr Clutch Autocentres Ltd.’s acceptance of your order brings into existence a legally binding contract between us on these terms.
    2. In the event of an obvious error or inaccuracy regarding the services offered on www.mrclutch.com, Mr Clutch Autocentres Ltd. is entitled to withdraw from any contract. If an error or inaccuracy is discovered with regards to the advertised price of the service(s) that you have ordered, we will contact you as soon as possible by email. This will be to inform you of the correct price of the service(s) and to ask you if you wish to continue with the order at the amended price, or wish to cancel the order altogether.
  3. General Terms
    1. These terms and conditions and all transactions relating to this website are governed by English law and are subject to the non–exclusive jurisdiction of the English courts. Mr Clutch Autocentres Ltd. does not accept amendments to these terms and conditions.
    2. Additional terms and conditions may apply for prize competitions, online bidding, pre–release orders and our added value services and offers. If so, you will be alerted to them at the relevant juncture.
    3. These terms and conditions cover only the Mr Clutch Autocentres Ltd. website. Any other websites which are linked to from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites, which are not under our control. We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.
  4. Delivery and Payment
    1. You will be liable to pay for the order immediately at the point of purchase.
  5. Place of Delivery
    1. Unless otherwise agreed in writing, delivery of the order shall take place at Mr Clutch Autocentres Ltd.’s premises.
  6. Payment Details
    1. Mr Clutch Autocentres Ltd. accepts payment by Visa, MasterCard, Switch, Maestro, Delta and PayPal. All product prices, service prices and delivery charges are shown in UK pounds sterling. Your payment company will perform any currency conversion. Payment will be taken at the point of purchase.
  7. Availability of Services that you Order
    1. If Mr Clutch Autocentres Ltd. has insufficient availability to deliver the service(s) that you order, we will notify you as soon as possible, where a rearrangement can be made for the service(s) to be delivered or, any sum debited by Mr Clutch Autocentres Ltd. will be refunded. The refund will be made as soon as possible and in any event within 30 days of your order. Mr Clutch Autocentres Ltd. will not be obliged to offer any additional compensation.
  8. Online Orders Cancellations and Distance Selling
    1. If, and only if, you have acted as a Consumer, where this Agreement has been completed away from our business premises and/or without any face to face contact between us and you; or anyone acting on your or our respective behalf, you may give notice to cancel this Agreement within 14 days without giving any reason.
    2. This cancellation period will expire after 14 days from the date that you place the order. To exercise this right to cancel, you must inform us of your decision to cancel this Agreement in writing (including by email) by clear statement (e.g. a letter sent by post, fax or email) to either Mr Clutch Autocentres Ltd. Head Office or the branch where the contract has been ordered. Mr Clutch Autocentres Ltd. will refund your original payment method without any deductions.
    3. This cancellation period will expire after 14 days from the date that you place the order. To exercise this right to cancel, you must inform us of your decision to cancel this Agreement in writing (including by email) by clear statement (e.g. a letter sent by post, fax or email) to either Mr Clutch Autocentres Ltd. Head Office or the branch where the contract has been ordered. Mr Clutch Autocentres Ltd. will refund your original payment method without any deductions.
    4. You may use the attached model cancellation form if you wish.
    5. To meet the cancellation deadline, it is sufficient for you to send your communication confirming your exercise of the right to cancel before the cancellation period has expired.
    6. If you cancel this Agreement, we will reimburse to you all payments received from you under this Agreement, without undue delay, and not later than14 days after the day on which we receive your notice to cancel this Agreement.
    7. We will make the reimbursement using the same means of payment as you have used for the initial transaction, unless you have expressly agreed otherwise, but in any event you will not incur any fees as a result of the reimbursement.
    8. For any online orders paid in advance for which you fail to keep the scheduled appointment or fail to notify us to make alternative arrangements or properly cancel, Mr Clutch Autocentres Ltd. shall retain fifty percent (50%) of the relevant advance payment and Mr Clutch Autocentres Ltd. shall refund to you the remaining fifty percent (50%) to your original payment method.
  9. Non Consumers
    1. You have the right to cancel any online purchase within 7 working days starting from the following full day of the date of purchase. This cancellation needs to be in writing (including email) to either Mr Clutch Autocentres Ltd. Head Office or the branch where the contract has been ordered. Mr Clutch Autocentres Ltd. will re-credit your original payment method without any deductions. If the order is due to start within the 7 working day cooling off period you will lose your right to cancel at the point that the service starts.
    2. For any online orders paid in advance for which you fail to keep the scheduled appointment or fail to notify us to make alternative arrangements or properly cancel, Mr Clutch Autocentres Ltd. shall retain fifty percent (50%) of the relevant advance payment and Mr Clutch Autocentres Ltd. shall refund to you the remaining fifty percent (50%) to your original payment method.
  10. Repudiation by Customer
    1. If you do not pay for the order at the point of purchase, Mr Clutch Autocentres Ltd. shall be at liberty to treat the contract as cancelled with immediate effect.
  11. Changes to This Agreement
    1. Mr Clutch Autocentres Ltd. reserves the right to make changes at any time to our website, policies, and these terms and conditions. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
  12. Variation
    1. Any variation agreed between Mr Clutch Autocentres Ltd. and you regarding the service(s) to be supplied shall be deemed to be an amendment to this contract and shall not constitute a new contract.
  13. Storage Charges
    1. Mr Clutch Autocentres Ltd. reserves the right to make a reasonable daily charge for the storage of the vehicle(s) following service(s) in the event that the vehicle(s) is not picked up by you by the agreed date and time.
  14. Dispute Resolution and Jurisdiction
    1. In the event of a complaint or dispute of any kind you can raise a complaint with our Customer Services team by emailing customerservices@mrclutch.com or calling 0800 67 67 67.
    2. Where your complaint cannot be resolved, and once you have exhausted our internal process, you may refer the dispute to the following alternative dispute resolution (ADR) process. We actively subscribe to the Retail Motor Industry (RMI) Federation, and through this membership, our customers have access to the National Conciliation Service (NCS). The NCS is an ADR scheme, and you can file a complaint with them using the contact details below:

Offer Terms & Conditions

    1. Printable website vouchers and offers must be printed and presented to the branch at the time of booking in the vehicle.
    2. Vouchers are not available in conjunction with any other offer, other than with a Mr Clutch Autocentres Ltd. Privilege card.
    3. Valid at participating branches only.
    4. Vouchers are valid at the time of print and may be subject to change or removal at any time.
    5. If a dated offer or alternative branch’s offer is presented then the current product range offer for that branch will be issued.
    6. Vouchers are not exchangeable for cash.
